These Terms &amp; Conditions (\u201cTerms\u201d) govern your access to and use of the Onool website and food delivery membership service (the \u201cService\u201d), operated by Onool (\u201cOnool,\u201d \u201cwe,\u201d \u201cus,\u201d or \u201cour\u201d). By creating an account, placing an order, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-9a487b6e\">1. About Onool<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-60d1d472\">Onool is a curated food delivery service offering same-day delivery of prepared meals, side dishes, and groceries from our partners to members in New York, New Jersey, New Hampshire, Massachusetts, Rhode Island, Connecticut, Pennsylvania, Delaware, Maryland, Washington, D.C., and Virginia. Membership is available as a free membership or a paid Onool Plus membership.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-3a67d258\">2. Eligibility<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-725403ea\">You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that any information you provide is accurate and current.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-f5f1f976\">3. Membership and Automatic Renewal<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-f2931f5d\">Onool offers a free membership and a paid Onool Plus membership (monthly or annual). Plus benefits, such as member pricing and free delivery, are described at https:\/\/onoolmarket.com\/ma\/member\/ and may change. This Section 3 and Section 4 apply to paid Plus memberships.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-d70ef69f\">Onool\u2019s paid membership is a subscription service that automatically renews at the end of each billing period until you cancel.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Billing.<\/strong> By signing up, you authorize Onool to automatically charge your payment method on file at the start of each billing period, at the then-current membership rate.<\/li>\n\n\n\n<li><strong>Auto-Renewal.<\/strong> Your membership will continue and automatically renew for successive periods unless you cancel before the renewal date. We do not require your reauthorization for each renewal charge \u2014 by subscribing, you\u2019re authorizing recurring charges until you cancel.<\/li>\n\n\n\n<li><strong>Price Changes.<\/strong> If we change the membership fee, we will provide advance notice before it takes effect on your account, giving you the opportunity to cancel before being charged the new rate.<\/li>\n\n\n\n<li><strong>No Automatic Refunds.<\/strong> Fees already charged for a current billing period are generally non-refundable, except as required by law or as otherwise stated in these Terms.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-7952a4f7\">4. Cancellation<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-9b69908b\">You may cancel your membership at any time through your account settings, or by contacting us at hello@onoolmarket.com. To avoid being charged for the next billing period, cancellation must be received at least 24-48 hours before your renewal date. If you cancel after that window, your membership will remain active (and you may continue to place orders) through the end of the then-current period, and it will not renew afterward.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-5700452c\">5. Orders and Delivery<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-d6bc7440\">Orders are placed through our website and fulfilled by our partners. Orders placed before 10 AM are prepared the same day and delivered between approximately 4 PM and 8 PM. Delivery days may vary by delivery area. Minimum order amounts and delivery fees may apply and are shown at checkout. We send text message updates about your delivery (see Section 16). If we do not yet serve your area, you can submit a request at https:\/\/onoolmarket.com\/ma\/location-request\/.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-a6372a5d\">Delivery times are estimates and are not guaranteed. Onool is not liable for delays caused by partners, weather, traffic, or other circumstances outside our reasonable control.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-0083c4f3\">Perishable items are packed refrigerated with ice packs and insulated bags. Please retrieve and refrigerate your order promptly after delivery. Onool is not responsible for spoilage that results from delay in retrieving or storing your order.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-882a1481\">6. Food Preparation, Quality, and Allergens<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-3391591b\">Onool\u2019s partners are independently responsible for preparing the food you order. While we curate our partners carefully, Onool does not prepare the food and is not liable for its quality, ingredients, or safety.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-b2e66ca2\">Some items (for example, raw fish or raw beef) are served raw or undercooked. Consuming raw or undercooked food may increase your risk of foodborne illness.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-5952e67e\">If you have a food allergy or dietary restriction, you are responsible for reviewing menu and ingredient information before ordering. Meals may be prepared in facilities that also handle wheat, egg, soy, milk, tree nuts, peanuts, fish, shellfish, or sesame, and cross-contact is possible even where not specifically listed. Onool does not guarantee that any dish is free of a particular allergen. If you have questions about a specific item, contact us or the partner before ordering. If you believe you are experiencing a medical emergency, call 911 \u2014 do not rely on Onool for medical guidance.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-731b956f\">7. Pricing and Payment<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-6d40152a\">All prices are listed in U.S. dollars and may change at our discretion, subject to the notice requirements in Section 3. Prices may differ between Free and Plus members. Promotional offers (including first-order benefits, group buys, and discounts) are subject to the terms stated with the offer and may be changed or ended at any time. Applicable taxes and fees are additional unless stated otherwise. You are responsible for keeping your payment information current; failed payments may result in suspension of your membership or order.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-89c87788\">8. Satisfaction Guarantee and Refunds for Orders<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-3699e2e7\">If there\u2019s a problem with your order \u2014 a missing item, incorrect item, or quality issue \u2014 or you are not satisfied, contact us within 7 days of delivery at hello@onoolmarket.com and we will refund your order in full. We may ask for a photo or description of the issue. Refunds are issued to your original payment method or, at our option, as account credit.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-fbc5a22f\">9. Service Area<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-0bb93cd6\">Onool currently serves New York, New Jersey, New Hampshire, Massachusetts, Rhode Island, Connecticut, Pennsylvania, Delaware, Maryland, Washington, D.C., and Virginia. Availability may vary by neighborhood and is subject to change without notice.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-12b1dc40\">10. Account Responsibility<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-a93b13c6\">You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at hello@onoolmarket.com if you suspect unauthorized use.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-f3cf669d\">11. Limitation of Liability<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-9e14bdf0\">To the fullest extent permitted by law, Onool and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages \u2014 including damages related to food quality, allergic reactions, delivery delays, or third-party partner conduct \u2014 arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to Onool in the [30 days] preceding the claim.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-cbd0cd2c\">12. Disclaimer of Warranties<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-6e565aba\">The Service and all food, content, and materials provided through it are offered \u201cas is\u201d and \u201cas available,\u201d without warranties of any kind, express or implied, to the fullest extent permitted by law.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-7be9cd7b\">13. Dispute Resolution<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-bd8f6200\">If a dispute arises, please contact us first at hello@onoolmarket.com so we can try to resolve it directly.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-73b6a071\">14. Governing Law<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-7d3a02e9\">These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-b610a2c4\">15. Changes to These Terms<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-b89dee30\">We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.<\/p>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-e11e6531\">16. Email and Text Messages<\/h2>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-ecae2df2\"><strong>Order and delivery messages.<\/strong> When you place an order, we send text messages and emails about it, such as delivery updates (typically around 12 PM, around 4 PM, and about 10 minutes before arrival). These are part of the Service and are not marketing.<\/p>\n\n\n\n<p class=\"wp-block-wd-paragraph wd-f2c9a6f7\"><strong>Marketing messages.<\/strong> By opting in (for example, by checking the text message box at checkout or registration), you agree to receive recurring automated marketing text messages from Onool Market, such as offers, new products, and member deals, at the mobile number you provided. By providing your email address and opting in, you agree to receive marketing emails from us. Consent is not a condition of any purchase or membership.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Frequency.<\/strong> Message frequency varies.<\/li>\n\n\n\n<li><strong>Rates.<\/strong> Message and data rates may apply.<\/li>\n\n\n\n<li><strong>Opt out.<\/strong> Reply STOP to any text at any time to cancel marketing texts; we will send one confirmation message. To stop marketing emails, use the unsubscribe link in any email. Opting out does not affect order, delivery, or account messages.<\/li>\n\n\n\n<li><strong>Help.<\/strong> Reply HELP to any text, or contact us at hello@onoolmarket.com or 978-727-7979.<\/li>\n\n\n\n<li><strong>Carriers.<\/strong> Carriers are not liable for delayed or undelivered messages.<\/li>\n\n\n\n<li><strong>Your number.<\/strong> You confirm that you are the account holder or authorized user of the mobile number you provide, and you agree to tell us if it changes.<\/li>\n\n\n\n<li><strong>Privacy.<\/strong> Your information is handled under our Privacy Policy. We do not share mobile phone numbers or text message consent with third parties or affiliates for their marketing or promotional purposes.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-wd-title title wd-ad78b9cf\">17.
